Student Enrollment / 10 Day Trial Agreement

I certify that I am at least 18 years of age. If under 18, my parent/guardian is the below signed.
Gracie Jiu Jitsu Jonesboro is independently owned and operated by Morgan Family Martial Arts LLC. The instructors are fully committed to the progress of each individual student. In order to make sure that their efforts are not wasted, it is of the utmost importance that each student is fully committed to the instructors, Gracie Jiu Jitsu Jonesboro, and most importantly, their own progress. This document serves as the binding agreement between you, the student, and Gracie Jiu Jitsu Jonesboro / Morgan Family Martial Arts. By signing this, you are demonstrating your commitment for the entire term of your membership.
I, THE STUDENT OR THE PARENT/GUARDIAN ON BEHALF OF THE STUDENT, UNDERSTAND, that under the terms of this agreement, the school obligates itself to furnish me with competent instruction and suitable facilities for teaching lessons. All class lessons are supervised by qualified personnel trained in the procedures and traditions of Gracie University. I agree that I am/my child is physically fit to receive and participate in the prescribed course of instruction. I agree to faithfully comply with all the rules and regulations of Gracie Jiu Jitsu Jonesboro (‘the school’) and Morgan Family Martial Arts LLC.
I, THE STUDENT OR GUARDIAN, UNDERSTAND that if my tuition is arranged to be made in monthly installments, Morgan Family Martial Arts has a fiduciary responsibility to collect all payments in a timely manner. Any modifications, changes, amendments, or cancellations of the student enrollment must be in writing. No oral amendments or modifications are to be made to the student enrollment agreement.
I FURTHER UNDERSTAND that the budgeted tuition payment plan is not affected by my training schedule and/or attendance. Morgan Family Martial Arts will automatically charge my billing method for monthly membership options. Tiered class limit memberships do not roll over un-used attendances and reset each calendar month.
I UNDERSTAND THAT I MAY CANCEL my membership at any time with a 30 day minimum written notice using the current cancellation notice form turned in to a staff member in person. Additionally, I’ve been informed that I am allowed to train during the 30-day cancellation period, or 30 days after my last bill was collected. All bills due within the 30 day notice period will be collected when due. Attendance cards will not be retained if I cancel.
I UNDERSTAND MAY PAUSE MY MEMBERSHIP by filling out a pause/freeze form in person. I will be allowed 1 freeze period per calendar year for up to two consecutive months/billing cycles. a $25 fee will be immediately collected per month/bill that I am freezing/pausing. My recurring bill will be differed to the date after the pause period and it will be collected when due.
All monthly training fees are due until proper cancellation procedures have been followed. In no case shall any monthly payment be retroactively refunded.
I SPECIFICALLY ACKNOWLEDGE and agree that the belt or other indicia of rank is a privilege and not a right. My acceptance of instruction from Gracie Jiu-Jitsu Jonesboro constitutes acknowledgement that I shall treat the students and the facilities with the utmost respect. If, at any point, my demeanor towards other students or my training practices are deemed to be unsafe or disrespectful, Gracie Jiu-Jitsu Jonesboro reserves the right to cancel this agreement. I shall be entitled to a refund of all unearned amounts due upon cancellation by the school.
I ASSUME ALL RESPONSIBILITY for any and all costs related to account collections, including but not limited to reasonable collection agency fees, court costs, reasonable attorney's fees, administrative fees and applicable late charges that may be incurred for default payments.
SCHOOL ADMINISTRATORS MAY MAKE any modifications to the class schedule as deemed necessary. Such modification does not relieve me of my payment obligations under any circumstances. School administrators also reserve the right to close the school on national holidays, for the purpose of special events, and a period not exceeding four weeks per year for necessary maintenance and other purposes without affecting scheduled tuition payments.
BY ENTERING INTO THE AGREEMENT, I grant the Gracie Jiu-Jitsu Jonesboro permission to use photographs, videotapes, artwork or other likenesses of me, the student, for marketing, trade, publishing, or any other lawful purpose, without remuneration.
MEMBERSHIP IS non-cancelable and non-transferable except as stated herein.
I AUTHORIZE the use of a disclosed e-mail address for billing purposes and acknowledge that e-mail text may include financial information pertaining to the membership.
10 DAY FREE TRIAL
If I have opted in to a 10 day trial, I understand that I have paid a deposit for an official jiu-jitsu uniform to use during a 10-day free trial period, and that should I decide to enroll at any time during the trial period, or when the trial is over, my deposit will be kept by Morgan Family Martial Arts LLC and the uniform will belong to me. If I wish to cancel my 10 day trial, it must be done in person on or before the end of the 10-day trial period. At the time of cancellation, I am required to return the full uniform in I was provided washed and free of stains and damage to receive a full refund of the deposit. If I do not return the uniform during the 10 day trial period, I authorize Morgan Family Martial Arts to keep my deposit and I will keep the uniform
I understand that my 10-day free trial period begins on the day I sign this agreement. The 10 day trial means that for 10 calendar days I can attend Gracie Jiu Jitsu classes and that this trial is not based on my attendance during the 10 day period.
I understand that Morgan Family Martial Arts / Gracie Jiu-Jitsu Jonesboro will collect a debit/credit card to use for automatic recurring billing for membership fees / tuition. I understand that if I do not cancel my 10 day trial that my first membership fee may draft on the 11th day to the payment method I have on file, or used to pay for the uniform. If my membership has tiered membership options, I will be defaulted to 8x per week.
FEES
I understand that there is a $10 processing fee to downgrade my membership, and that changes to my recurring bill in response to a request to downgrade membership level will take place on the following recurring bill. These requests must be made in person. Tuition is not refundable.
A $10 registration fee may be collected when a trial student converts to paid membership. Staff can elect to waive the fee in leu of a Google of social media review.
Gracie Bullyproof students are charged a $45 fee that pays for part of the cost and shipping of the belt when students are eligible for promotion. I authorize the school to order the belt and charge my account when my child qualifies and is determined to be ready for promotion.

WAIVER / RELEASE / ASSUMPTION OF RISK
PLEASE READ CAREFULLY – THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS
In consideration of being allowed to participate in activities at Gracie Jiu Jitsu Jonesboro, I hereby acknowledge and agree as follows:

I have been advised martial arts known as "Gracie Jiu-Jitsu", Brazilian Jiu Jitsu, Judo, and Wrestling are taught using precautions to avoid any injuries. However, participation in the Gracie Jiu-Jitsu and other martial arts classes carries with it certain inherent risks and dangers that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks range from minor injuries such as scratches, bruises, and sprains, to major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions, to catastrophic injuries including paralysis and death. Knowing the potential hazards, I elect to voluntarily participate in activities at Gracie Jiu Jitsu. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISTS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or loss or damage to property owned by me, as a result of participation.
The practice of Gracie JiuJitsu and any other martial art presents a risk of skin infections, MRSA, transmittable diseases, bacteria(s) and viruses, including, but not limited to, COVID-19.
I shall not attend Gracie Jiu-Jitsu classes if I am diagnosed with COVID-19 or if I am in close contact with someone diagnosed with COVID-19. Further, if I am displaying symptoms of COVID-19, or if I am in close contact with someone who is displaying symptoms of COVID-19, I shall not attend Gracie Jiu-Jitsu classes. Symptoms of COVID-19 can range from mild illness to pneumonia, including fever, respiratory symptoms such as coughing, sore throat and/or shortness of breath, and other symptoms such as a runny nose, headache, muscle or joint pains, nausea, diarrhea, vomiting, loss of sense of smell, altered sense of taste, loss of appetite and fatigue. If I am displaying these symptoms when in attendance at Gracie Jiu-Jitsu classes I acknowledge that I may be asked to leave.
Along with the possibility of personal injury, injury to property is also possible, including but not limited to, possible loss of wages and the ability to earn such wages.
I acknowledge that I have consulted with a physician and I have no health problems that would preclude me from full and safe participation in Gracie Jiu-Jitsu. It is my responsibility as a parent or student to notify staff of any medical conditions, and to be present to administer any medicines needed for pre-existing medical conditions including but not limited to asthma, hear disease, diabetes, seizures, etc should the emergent need arise during class.
With full knowledge and understanding of the aforementioned risks, both to myself and to my property, and after having these dangers fully explained to myself and/or to my legal guardian I nevertheless desire to participate in Gracie Jiu-Jitsu training and activities.
I, for myself and my heirs, assigns, personal representatives and next of kin release, indemnify, and hold harmless Morgan Family Martial Arts, LLC, and Gracie Jiu Jitsu Jonesboro, and their officers, servicant, agents, independent contractors, volunteers, and employees, from any and all causes of action (including but not limited to negligence), claims, demands, losses, expenses (including attorneys’ fees and costs), and liability arising out of or related to any injury, disability, or death that I may suffer, or loss of or damage to property (including teft by third parties), arising directly or indirectly from my participation in physical activity or while in or upon the premises where physical activity is being conducted.
Due to the nature of the activities conducted in Gracie Jiu Jitsu classes, it would be unreasonable for Gracie Global, LLC (d.b.a. Gracie University), Morgan Family Martial Arts LLC (d.b.a. Gracie Jiu Jitsu Jonesboro) and/or the respective owners, directors and shareholders, agents, independent contractors and employees to be in any way responsible for my injury (or death) and to the full extent of the law I hereby waive my legal rights of action against and fully release the company for loss, damages, injury or death however arising out of or in relation to my participation in the activities conducted or organized by the company including, without limitation, liability for any negligent or tortious act or omission, breach of duty, breach of contract or breach of statutory duty on the part of the company, its office bearers, directors, employees or agents.
It is my expressed intent that this release agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns, and personal representative, if I am deceased, and shall be deemed as a release, waiver, discharge, and covenant not to sue,
I authorize any emergency first aid, CPR, AEDs, medication, medical treatment, and/or emergency transportation and I assume all costs involved in such treatment.
I understand that Gracie Jiu-Jitsu Jonesboro reserves the right to refuse service to any individual who has been convicted of a sex crime.
I will not video record or photograph any classes/training without prior permission from the owner of Gracie Jiu Jitsu Jonesboro.
I am also aware that for purposes of safety, security and quality control there are surveillance cameras mounted throughout Gracie Jiu-Jitsu Jonesboro. Furthermore, I understand and acknowledge that video recording or photographs may be taken of me during classes/training. I hereby grant Morgan Family Martial Arts, LLC (d.b.a. Gracie Jiu Jitsu Jonesboro) the unlimited use of my likeness in any format – photo, video, or other – for promotional advertisement or commercial use in any format known or yet to be developed in perpetuity, and I forfeit any form of payment.
I agree that if any term of this agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, all other terms shall remain in full force and effect.
I understand that this agreement supersedes any and all previous oral or written agreements with regards to the practice of Gracie Jiu Jitsu and I give up substantial rights by signing it.
I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
I have also read the student enrollment / 10 trial agreement. I am aware that 30 days notice must be given in person to cancel my membership. All tuition due within the 30 days notice period will be collected.
I intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
